Original Abstract

Este escrito tiene como propósito responder a la siguiente pregunta problema ¿Como se 
soluciona la tensión entre el derecho a la libertad de culto y el derecho a la salud en el marco 
Constitucional colombiano, en referencia a la transfusión de sangre en los testigos de Jehová? 
desarrollando las diferentes aristas dentro del marco constitucional en los cuales se permita 
garantizar el derecho a la salud y la libertad de cultos, para la transfusión de sangre a las personas 
que hacen parte de la comunidad religiosa Testigos de Jehová. Para efectos de lo anterior se hará 
énfasis en el mandato de optimización entre los derechos a la salud y a la libertad de cultos, frente 
a la realidad de esta población específica. La metodología empleada en nuestro proyecto fue una 
revisión cualitativa, que abarcó el análisis exhaustivo de avances jurisprudenciales relacionados 
con el derecho a la salud y a la libertad de cultos en el contexto de la transfusión de sangre. Esta revisión consistió en analizar cada una de las sentencias, destacando especialmente aquellas 
consideradas hito en el desarrollo de estos derechos.The purpose of this paper is to answer the following question: How is the tension 
between the right to freedom of worship and the right to health resolved in the Colombian 
Constitutional framework, with reference to Jehovah's Witnesses? developing the different 
aspects within the constitutional framework in which the right to health and freedom of worship 
can be guaranteed, for the transfusion of blood to people who are part of the Jehovah's 
Witnesses religious community. For the purposes of the above, emphasis will be placed on the 
mandate of optimization between the rights to health and freedom of worship, facing the reality 
of this specific population, in order for the judicial system to guarantee and ensure both. The 
methodology used in our project is analytical, which consists of a procedure that decomposes a 
whole in its basic elements and, therefore, that goes from the general to the specific, trying to 
cover all the content of the specific topic, exposing each of its edges, from an empirical  reasoning that allows the understanding of the phenomena that are presented around the
