Original Abstract

O presente trabalho versa sobre o direito de recusa a tratamentos que envolvam o uso de sangue por pessoas pertencentes à religião “Testemunhas de Jeová”,
analisando para isso o aparente conflito de direitos fundamentais que se estabelece, onde de um lado está a necessidade de proteção da vida humana, como direito individual e como valor protegido pela constituição (art. 5º, CF), e do outro lado à liberdade religiosa, igualmente compreendida como direito fundamental e também protegida pela Constituição Brasileira (art. 5º, VI, CF). Além de verificar qual vem sendo a posição atual dos tribunais brasileiros, nos casos envolvendo a recusa de pacientes testemunhas de Jeová a tratamento hemoterápico, no que diz respeito à aplicação do princípio da autonomia da vontade e liberdade de autodeterminação do paciente, em contraposição a responsabilidade médica de fornecer o melhor e mais eficaz tratamento possível, na manutenção da vida do paciente.The present work deals with the right to refuse treatments that involve the use of blood by people belonging to the “Jehovah’s Witnesses” religion, analyzing the apparent conflict of fundamental rights that is established, where on the one hand is the need for protection of human life, as an individual right and as a value protected by the Constitution (art. 5, CF), and on the other hand, religious freedom, also
understood as a fundamental right and also protected by the Brazilian Constitution (art. 5, VI, CF). In addition to verifying the current position of the Brazilian courts, in cases involving the refusal of Jehovah's Witness patients to hemotherapy treatment, with regard to the application of the principle of autonomy of will and freedom of selfdetermination of the patient, as opposed to responsibility physician to provide the best and most effective treatment possible, in maintaining the patient's life.26 f
